Probative is an artificial intelligence assisted legal analysis platform designed to help legally qualified practitioners review affidavits and identify potential evidentiary issues. The platform is governed by Australian law.
Access to Probative is restricted to legally qualified practitioners, including solicitors, barristers, and other legal professionals admitted or otherwise authorised to practise law in their jurisdiction. By using the platform you represent and warrant that:
Probative does not provide services to members of the public. If you are not a legally qualified practitioner or authorised staff member, you must not use the platform.
You acknowledge that all output produced by the platform:
You must not represent AI-generated output as your own professional advice or work product without independent review and verification.

Analysis is performed using Anthropic's Claude AI via their commercial API. By using the Service, you acknowledge that document content will be transmitted to Anthropic, Inc. (United States) for processing and is not retained by Probative after analysis.
Regarding their commercial API data handling, Anthropic states on their Privacy Centre: "By default, we will not use your inputs or outputs from our commercial products (e.g. Claude for Work, Anthropic API, Claude Gov, etc.) to train our models." Anthropic further states that it automatically deletes inputs and outputs within 30 days of receipt or generation. This period is set by Anthropic and may change — at the time of writing it is 30 days; verify the current position at privacy.anthropic.com before relying on it. These commercial API terms are entirely separate from Anthropic's consumer product terms. Anthropic's current policies are available at privacy.anthropic.com.

Probative offers a limited free sample analysis covering a subset of paragraphs per document. Free samples are provided for evaluation purposes only. Probative reserves the right to modify or withdraw the free sample offer at any time. The sample analysis is not a complete review of any document.
Paid services operate on a per-matter package model. You select a package before your document is analysed, and your saved card is charged once, at the time the report is generated. The current packages are:

Multi-affidavit packages are charged once, up front. Each affidavit is then analysed separately, producing its own report and Schedule of Objections.
Where a package includes Draft Objections, the objections document is included in the package fee — generating it incurs no further charge. The package fee covers both the analysis report and the generation of the associated objections document.
Payment is processed by Stripe, Inc. Card details are stored by Stripe for the convenience of future transactions. We do not store card numbers or CVV codes. All amounts are in Australian dollars. GST is charged in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Prices may be varied by us on reasonable notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
Given the nature of the Service (immediate delivery of digital analysis), packages are generally non-refundable once the report has been generated. Where you have purchased a package that includes Draft Objections, the package fee covers both the report and your ability to generate the objections document; no refund or part-refund arises from your choosing not to generate, or not to use, the objections document. If you believe a charge has been applied in error, contact us at email@probative.app within 14 days and we will review the matter.
Your use of the platform is governed by our Privacy Statement, which is incorporated into these Terms by reference.
In summary: your document's text transits through our systems for analysis and is not retained after that process completes. We store a billing record consisting of your firm name, the name and email of the person who ran the report, the file name as uploaded, the matter name and matter number you enter, the amount charged, and the date. We never retain the text or contents of your document. Analysis results exist only in your browser session and are deleted when you close your tab. Refer to the Privacy Statement for full details, including the list of third-party service providers who process data on our behalf and the website usage data we collect.
All rights in the Probative platform, including its software, design, and content, are owned by or licensed to Probative. You may not copy, reproduce, modify, or distribute any part of the platform without prior written permission.
You retain ownership of any documents you upload. By uploading documents you grant us a limited, temporary licence to process those documents solely for the purpose of delivering the analysis service. We do not claim any rights in your documents or client information.
To the maximum extent permitted by law, Probative and its directors, officers, employees, and contractors exclude all liability for any loss, damage, claim, or adverse outcome arising directly or indirectly from:
Where liability cannot be excluded by law, it is limited to the amount paid by you to Probative in the 12 months preceding the relevant claim, or $100 AUD, whichever is less.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be excluded or limited by agreement. Where the Australian Consumer Law applies, our liability is limited, at our option, to resupply of the relevant service or payment of the cost of having the service resupplied.
Probative may update these Terms from time to time. Material changes will be communicated by email to account holders. Continued use of the platform after updated Terms are posted constitutes acceptance of the updated Terms. The effective date of the current version is shown at the top of this page.
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
By creating an account with Probative, you consent to receiving electronic communications from us in connection with your account and your use of the service. These communications may include:
You may withdraw your consent to receive non-essential commercial electronic messages at any time by clicking the unsubscribe link included in every marketing or product update email we send. Transactional communications necessary for the operation of your account — including password reset emails and billing notices — will continue regardless of your marketing preferences.
We comply with the Spam Act 2003 (Cth) in relation to all commercial electronic messages. Each commercial message we send includes a functional unsubscribe mechanism. We will give effect to unsubscribe requests promptly.
