Probative is an artificial intelligence assisted legal analysis platform designed to help legally qualified practitioners review affidavits and identify potential evidentiary issues. The platform is operated from Australia and is governed by Australian law.
Access to Probative is restricted to legally qualified practitioners, including solicitors, barristers, and other legal professionals admitted or otherwise authorised to practise law in their jurisdiction. By using the platform you represent and warrant that:
Probative does not provide services to members of the public. If you are not a legally qualified practitioner, you must not use the platform.
The platform does not provide legal advice and does not act as a solicitor, barrister, or legal advisor. Nothing produced by the platform constitutes legal advice. Use of the platform does not create a solicitor-client, barrister-client, or any other professional or advisory relationship between Probative and any user or their client.
All output produced by the platform is generated by artificial intelligence and is suggestive only. It does not determine admissibility, evidentiary weight, or any legal question in any proceeding.
You acknowledge that all output produced by the platform:

Probative offers a limited number of free sample analyses per user. Free samples are provided for evaluation purposes only. Probative reserves the right to modify or withdraw the free sample offer at any time. The sample analysis covers a subset of paragraphs only and is not a complete review of any document.
Paid services are available subject to separate pricing terms presented at the time of purchase. All prices are exclusive of GST unless otherwise stated. GST is added at checkout where applicable. Probative reserves the right to change pricing at any time with notice.
Your use of the platform is also governed by our Privacy Statement. Documents uploaded for analysis are processed and immediately discarded. Probative does not retain or store document content after analysis is complete. Your email address is collected and retained for account and communications purposes as described in the Privacy Statement.
All rights in the Probative platform, including its software, design, and content, are owned by or licensed to Probative. You may not copy, reproduce, modify, or distribute any part of the platform without prior written permission. You retain ownership of any documents you upload. By uploading documents you grant Probative a limited, temporary licence to process those documents solely for the purpose of delivering the analysis service.
To the maximum extent permitted by law, Probative and its directors, officers, employees, and contractors exclude all liability for any loss, damage, claim, or adverse outcome arising directly or indirectly from:
Where liability cannot be excluded by law, it is limited to the amount paid by you to Probative in the 12 months preceding the relevant claim, or $100 AUD, whichever is greater.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be excluded or limited by agreement. Where the Australian Consumer Law applies, Probative's liability is limited, at its option, to resupply of the relevant service or payment of the cost of having the service resupplied.
Probative may update these Terms from time to time. Continued use of the platform after updated Terms are posted constitutes acceptance of the updated Terms. The effective date of the current version is shown at the top of this page.
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
