1.Where your material lives
Your documents are read in the browser, on your own computer. They are not uploaded to Probative. Probative's servers store no document content — only account details and the matter reference (name and number) needed for your tax invoice.
Nothing persists after your browser window closes. Your work product exists only in your session and in any exports you choose to save.
2.How the AI processes it
To read your material and draft the documents you request, pages are transmitted encrypted (TLS) to our AI provider and processed under commercial enterprise terms which provide that customer content:
The provider retains API inputs and outputs only transiently, for trust-and-safety purposes, before deletion. A zero-data-retention arrangement is in progress; this statement will be updated the day it takes effect.
3.The character of the disclosure
Stated as fact, for your own assessment: nothing is communicated to the public; no other party can access your material; the transmission is confidential, to a service provider bound by the terms above, solely for your own preparation of your client's matter. It is of the same character as the confidential use of transcription, copying, translation or eDiscovery providers in litigation.

4.Built for the Practice Direction
For those that practise in family law: Probative was built by Australian family lawyers with the Court's Practice Direction of 29 May 2026 on the use of AI in mind. Every output is referenced to its source — page and paragraph — so it can be verified before it is relied on. Outputs are drafting aids, not advice; the practitioner's duty to the Court is unaffected and remains theirs.
